More is happening
My last (I hope) meeting with city council is on Monday. To finalize ellimination of easements and curb in the whole parking lot. I will let you know. Grading has started. We tried to save trees most were scrappy pines. Enjoy the pictures. Hope you all are well. Claire

We have all permits
On friday we had the opt out of IMUD recorded ,paid the fee for water run off to Davis lake(caching)and yesterday we paid the fee to have all easements to be elliminated from site plan-should be recorded soon. Grader had been notified and I hope he will start soon. No new pictures because the site looks the same. It rained last night-sooo when it dries out I assume it will all start. We are excited. We are out
We are out of the IMUD and are working on the details to get all easments elliminated. Not a bad meeting. Thank you for all of your prayers and concerns. I will write more later- have to get back to work. Grading should start ASAP. Claire

Meeting Date Set
I have been informed by the non owner that the only time we can meet is Sept 9 @9:30 at city hall. We asked for a different time since I will have to reschedule patients to meet with interested parties. This was not up for discussion or at least they didn't seem to want to negociate a reasonable or more convenient time,like real early or later. Not being in the IMUD would assure that any furture issue would not involve me and disrupt patient care. I would prefer to only have to be concerned with individual stand alone practice. Abigail Pittman is going to discuss with my Architech our proposal to opt out of the IMUD. She is very capable and it will be good to have her working with me. Claire

Still Waiting
Have heard only from one owner and he is reviewing the maps taken to him on Friday. No return calls from the others. One owner says he has no problem with me opting out of the IMUD. Claire

More About IMUDS
I left you last with opting out of IMUD. My contractor called me to tell my surveyor to put everything together to opt out. The city said it should not be a problem to opt out. So good ol Tim goes to work and finds out from the city exactly what is required. One of the requirement is to get all of the current land owners to agree to my opting out. We got the names plus one that we thought was an owner. This individual has been very verbal about not sign ing if my opting out wasn't an advantage to --. The other day Tim showed me how to ,and where to go to pull up deed, property transactions etc. So I started looking, I can't find anywhere that this person is a land owner in this IMUD. I did find where this person had entered into an agreement with the land owners of a parcel putting restrictions on the property they owned next to where this person operates a business. It was formed in Feb or March of this year and marked urgent.Note that this agreement only talks about the 2 front properties. In conversation it has been implied that the individuals that own the abutting propery and (this person) are partners. This person advised us that nothing would be signed until the partner could come to NC from MO and not until the middle of Sept. On friday when my contractor advised me of this he said his friend the owner of the other piece of property would agree any signage and lets just stay in-Not after this. The other owner has the property listed. So look what I am stuck with for the next 10yrs-a strong arm who wants to dictate what everybody else does in the complex and is not even a property owner. An aside-While surfing Guilford County web site I found a document describing restrictions-that I asked prior to purchasing the propery if such a document existed(was told no by Jim Bishop the broker for the seller) on the property (IMUD). My main concern is if I am to allow all traffic in the complex to pass through my parking lot it would be an undue hardship and wear on my parking lot and then I would be the one responsible for maintaining it. Parking lot pavement is expensive. In the zoning meeting my lawyer assured me that I" got what I wanted". There are still people around that tell me that isn't true. This week I tried tocall my lawyer for clarification and can't get a returned call. Guess what firm drew up the document regarding restriction with the unnamed indivual non owner-the same firm I use. I wonder is this the reason I can't get a call back. Come monday I have a lot checking up on things, see patients, help train a new employee and .... I won't say I wasn't warned but much of this seems like a lot of inefficient use of time. I think of the people that aren't fortunate enough to have a surveyor like Tim Duncan with KennedyDuncan. But you know what he was raised right here in Deep River and I know was raised with ethics of the good ol country. Now I have this off my chest. Will let you know later what follows. This is such a good forum for me not to be whitching about this all the time. Again I Thank God for my intuitive senses and people like Tim Duncan and all you people that bear with me through this. Now God help me be strong and react in the manner that we are called. I fail at times and ask His and your forgiveness when I do. Claire

Not much happening
Back when we were rezoning there was the discussion about IMUDS. Well my contractor suggested that we opt out of the IMUD,and I agree it is a good idea. To do so the city recommended that we apply to opt out by submitting the request along with the suvey. This has been done. We also needed to get permission ( one reason to opt out of IMUD) from all of the other owner. OF the five other owner one said he would not sign unless it was to his advantage. It's not really a matter of advantage or disadvantage to the other owners. Any way the one owner didn't have a copy of the IMUD regulations so we send them to him via fax. This owner remains anonymous. His partner is the manager,owner of and their property is the most proximal from my property. The city had said if I get the signatures by today they would make their decision. So we wait. The other aspect of the whole IMUD issue is that I have to have permission from all to start grading. Otherwise I could start even without the building permit because my property is less than an acre. So we can't even grade until this issue is resolved. Hopefully next week will see more action.

Hiccup
The city has the building permit to aprove. We have less than a acre of land so really don't need to get a grading permit but....Some at the city seem to think that this is still an IMUD-it is my understanding that after our work with planning and zoning the this was not true. Any way the lawyer is checking. We wait. No new pictures. It's interesting I woke up this morning at 1:30 thinking about the grading. The telephone box move to the left of the drive is complete.Yea!! Now the light pole has to be moved. Who planned the drive way position. The City of High Point. We'll talk later. Claire
